San Bernardino, CA –
Today, San Bernardino County District Attorney Michael A. Ramos and Senior Assistant Attorney General Gary Schons announced that a criminal Grand Jury returned a 29-count indictment naming Paul Biane, former member of the Board of Supervisors; Mark Kirk, former Chief of Staff for Board member Gary Ovitt and current Director of Government Relations in the County Administrative Office; James Erwin, former Chief of Staff for Board member Neil Derry; and, Jeffrey Burum, a General Partner of Colonies Partners, L.P.
All four are charged in Count 1with Conspiracy to Commit Bribery, Misappropriation of Public Funds, Improper Influence and Conflict of Interest in violation of Penal Code Section 182. Additionally, Paul Biane is charged with Conflict of Interest, Misappropriation of Public Funds, Fraudulent Tax Return, Perjury, Filing a False Instrument, and two Bribery counts, all Felonies. Mark Kirk is also charged with Bribery, Improper Influence, Conflict of Interest, Misappropriation of Public Funds, Fraudulent Tax Return, Perjury, and Filing a False Instrument, all Felonies. James Erwin is further charged with Conflict of Interest, Misappropriation of Public Funds, Forgery, Fraudulent Tax Return, Willful Failure to File a Tax Return, four counts of Perjury, three counts of Filing a False Instrument, and four counts involving Bribery, all Felonies. The object of the conspiracy charge was to illegally obtain $102,000,000 from the County, for personal gain, and for certain public officials to profit from those gains by forsaking their solemn duties and responsibilities to the County and the citizens they served, in violation of their oaths of office and the laws of the State of California.
District Attorney Michael A. Ramos stated, “I am proud of the tenacity and dedication of my Public Integrity Unit and our partners in the Attorney General’s Office. The team worked long, hard hours to put all of the pieces together involving this complex case. I am pleased that the matter will now move to the arena of the courtroom, where we intend to prove our case and finally see justice done. I hope this sends a strong message that corruption will no longer be tolerated in San Bernardino County.”
